Terms of Service
These Terms of Service ("Terms") govern your use of AfterShow. AfterShow is a customer-retention and analytics service operated by AfterShow, Inc., a Georgia corporation. By creating an account or using the service, you agree to these Terms. If you do not agree, you may not use AfterShow.
Your account
To use AfterShow, you must be at least eighteen (18) years of age and capable of forming a binding contract. By creating an account, you represent that you meet these requirements.
You are responsible for the accuracy of information you provide, for keeping your sign-in credentials secure, and for all activity that occurs under your account. Notify us at hello@aftershow.net if you suspect unauthorized access.
You may sign in with email and password or through a supported third-party provider such as Google or Meta. If you sign in with a third-party provider, your continued ability to use AfterShow through that provider depends on the provider's continued availability and your account's good standing with that provider.
Subscription, beta, and billing
AfterShow may be offered as a free service, a paid subscription, or a combination. Current pricing and plan terms are described on our pricing pages and at the point of subscription.
If you subscribe to a paid plan, you authorize us and our payment processor (Stripe) to charge your selected payment method on a recurring basis until you cancel. Subscriptions renew automatically at the end of each billing period unless canceled. You can cancel at any time from your account settings; cancellation takes effect at the end of the current billing period and you retain access until then.
We may offer beta access, trial periods, or promotional discounts. Beta and trial access may be subject to additional terms (for example, expiration dates and feature limitations) that are described at the time the access is offered.
Refunds: paid charges are generally non-refundable. We may, in our sole discretion, issue prorated refunds in cases of confirmed service failure on our side.
Taxes: prices are exclusive of applicable taxes, which may be added at checkout depending on your location.
Imports and your data
AfterShow lets you import order history, customer lists, engagement data, and similar information from third-party seller platforms by uploading files you have exported from those platforms.
Your representations regarding imported data
When you import data into AfterShow, you represent and warrant that:
- You have the legal right to export the data from the source platform and to import it into AfterShow.
- You will use the imported data only in ways permitted by applicable law and by the terms of service of the source platform.
- If the imported data includes contacts you intend to communicate with through AfterShow, you have obtained any consents required by applicable law (including, where relevant, the CAN-SPAM Act, TCPA, GDPR, UK GDPR, PIPEDA, CASL, and similar regimes).
- You will not import data that you obtained through scraping, unauthorized access, purchase from third-party data brokers without the contacts' consent, or any other method that violates the rights of the people whose data it is.
AfterShow does not independently verify your right to import or use any data you upload. You bear sole responsibility for your compliance.
Ownership and access
You retain all rights in the data you import. You grant AfterShow a limited, non-exclusive, worldwide license to host, process, transmit, and display the data solely as needed to provide the service to you and any others you authorize to access your account.
We do not share your imported data with other AfterShow creators. We do not sell your imported data. We do not use your imported data to train general-purpose AI models. Our processing of imported data for AI-powered insights is described in the Privacy Policy.
Deletion and export
You may delete imported records, audience entries, and other data at any time from inside the product. You may also export your data using the export features. Account-level deletion is described in Termination below.
Third-party seller platforms
AfterShow supports importing data from a number of third-party seller platforms, including but not limited to live-selling platforms, online marketplaces, peer-to-peer resale platforms, and direct-to-consumer commerce platforms. These third-party platforms are owned and operated by their respective companies and are not affiliated with, endorsed by, sponsored by, or in any way associated with AfterShow.
All platform names, logos, and trademarks remain the property of their respective owners. References to any specific platform in our product or marketing are for descriptive and interoperability purposes only.
Your use of any third-party platform is governed by that platform's own terms of service and privacy policy. You are responsible for ensuring that your export and import of data, and your subsequent use of that data through AfterShow, complies with those platforms' terms. AfterShow is not responsible for any consequence arising from your use of, or violation of, a third-party platform's terms.
AfterShow does not, by default, directly access these platforms' APIs or accounts. The standard import flow is file-based: you export from the platform, you upload to AfterShow. If you choose to enable a specific direct integration (such as an Instagram or Facebook integration through Meta sign-in), the additional terms and required permissions for that integration will be presented to you before you enable it.
Broadcasts and communications
AfterShow lets you send email, SMS, and MMS broadcasts to people on your contact list. When you initiate a broadcast, you are the sender of that communication. AfterShow acts as a service provider that delivers the message on your behalf.
As the sender, you are responsible for ensuring that your broadcasts comply with all applicable laws and best practices, including:
- CAN-SPAM (US, email): accurate header and subject lines, clear identification as a commercial message where applicable, a valid physical postal address, and a functional unsubscribe mechanism honored within ten (10) business days.
- TCPA (US, SMS and MMS): prior express consent (or, for marketing messages, prior express written consent) from each recipient, honoring opt-out requests, and observing time-of-day and quiet-hour restrictions.
- GDPR and UK GDPR (EU, EEA, UK): appropriate lawful basis (often consent for marketing), purpose limitation, and respect for data subject rights.
- CASL (Canada): consent and identification requirements.
- Other applicable laws of the jurisdictions in which your recipients reside.
AfterShow automatically includes unsubscribe and opt-out handling in broadcast messages. You may not disable, alter, route around, or attempt to bypass these mechanisms. We may suspend or terminate accounts that generate excessive complaints, that send to addresses obtained without consent, or that otherwise misuse the broadcast features.
Acceptable use
You agree not to use AfterShow to:
- Violate any applicable law or regulation
- Send unlawful, deceptive, harassing, threatening, or defamatory communications
- Send unsolicited bulk communications (spam) to people who have not consented to receive them from you
- Infringe the intellectual property, privacy, publicity, or other rights of any person or entity
- Upload, transmit, or transfer any virus, malware, or harmful code
- Attempt to gain unauthorized access to AfterShow systems, other accounts, or any data not your own
- Reverse engineer, decompile, or attempt to extract the source code of AfterShow, except to the extent expressly permitted by law
- Use automated means (bots, scrapers) to access AfterShow other than as expressly permitted
- Resell, sublicense, or commercially exploit access to AfterShow without our written permission
- Interfere with or disrupt the integrity, performance, or security of AfterShow
We may investigate and take appropriate action against any conduct we reasonably believe violates these Terms.
Intellectual property
AfterShow, including the software, design, branding, and content we create, is owned by AfterShow, Inc. and protected by intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to access and use AfterShow for its intended purpose, subject to these Terms.
The "AfterShow" name, logo, and related marks are trademarks of AfterShow, Inc. You may not use them without our prior written permission, except for accurate, non-misleading references such as identifying that you use AfterShow.
If you provide us with feedback or suggestions about AfterShow, you grant us an unrestricted, perpetual, royalty-free license to use that feedback to improve the service. We will not identify you publicly as the source of feedback without your consent.
AI features
AfterShow includes optional AI-powered features that analyze imported data and surface insights. These features are powered by third-party AI providers operating under contract with AfterShow.
AI-generated outputs are provided for informational purposes only. They may be incomplete, inaccurate, or out of date. You should not rely on AI outputs as a sole basis for business, legal, financial, medical, or other consequential decisions. You remain responsible for verifying outputs and for any actions you take based on them.
Details of what data is sent to AI providers and how it is handled are described in our Privacy Policy.
Termination
You may close your account at any time from your account settings. Closing your account ends your right to use AfterShow and begins the data deletion process described in the Privacy Policy.
We may suspend or terminate your account if you violate these Terms, if your account creates legal or security risk for us or our other users, if required by law, or if we discontinue the service. Where reasonable, we will provide notice and an opportunity to address the issue before terminating.
On termination, your right to use AfterShow ends immediately. Provisions that by their nature should survive termination (including ownership, disclaimers, limitations of liability, indemnification, and dispute resolution) will survive.
Disclaimers
AfterShow is provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, statutory, or otherwise. To the maximum extent permitted by law, we disclaim all warranties, including without limitation warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, and quiet enjoyment.
We do not warrant that AfterShow will be uninterrupted, secure, or error-free, that defects will be corrected, or that the service or the servers that make it available are free of viruses or other harmful components. Your use of AfterShow is at your own risk.
We do not warrant that using AfterShow will increase your sales, subscriber count, revenue, or audience engagement. Results depend on your own business practices, the quality of your products, and how you communicate with your audience.
AfterShow is not affiliated with, endorsed by, or sponsored by any third-party seller platform. We make no representations or warranties about the data you import from those platforms, your right to import it, or the consequences under those platforms' own terms.
AfterShow is not a law firm and nothing in these Terms or on our platform constitutes legal advice. If you need guidance on CAN-SPAM, TCPA, GDPR, or other legal requirements that apply to your communications, consult a qualified attorney.
Limitation of liability
To the maximum extent permitted by applicable law, in no event will AfterShow, Inc., its officers, directors, employees, contractors, agents, or licensors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including without limitation lost profits, lost revenue, lost data, business interruption, or loss of goodwill, arising out of or in connection with these terms or your use of AfterShow, whether in contract, tort, strict liability, or any other theory, and whether or not we have been advised of the possibility of such damages.
Our total aggregate liability arising out of or relating to these terms or the service will not exceed the greater of (a) the amount you paid to us for the service in the twelve (12) months preceding the event giving rise to the liability, or (b) one hundred US dollars ($100).
Some jurisdictions do not allow the exclusion or limitation of certain damages, so portions of the above may not apply to you. In those jurisdictions, our liability will be limited to the greatest extent permitted by law.
Indemnification
You agree to defend, indemnify, and hold harmless AfterShow, Inc. and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with: (a) your access to or use of AfterShow; (b) your violation of these Terms; (c) your violation of any third-party right, including without limitation any intellectual property or privacy right; (d) your import, use, or distribution of any data through AfterShow; or (e) your communications to recipients via AfterShow's broadcast features.
Disputes and governing law
These Terms are governed by the laws of the State of Georgia, United States, without regard to its conflict-of-law principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
You and AfterShow agree that any dispute arising out of or relating to these Terms or the service will be resolved exclusively in the state or federal courts located in Muscogee County, Georgia, and you and AfterShow consent to the personal jurisdiction of those courts.
Either party may seek injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property or confidential information.
Changes to these terms
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page and, where required by law or where the changes materially affect your rights, give you reasonable notice through the service or by email. Continued use of AfterShow after changes take effect means you accept the updated Terms. If you do not agree to the updated Terms, you may close your account.
